Turbocam Wins ADA Claim, but Title VII Case Proceeds After Religious-Liberty Ruling
October 4, 2026
A September 28 federal court order in Bernier v. Turbocam, Inc. addressed cross-motions for summary judgment in Lillian Bernier’s lawsuit. Bernier alleges Turbocam denied insurance coverage for gender-affirming care. The court granted Turbocam summary judgment on Bernier’s Americans with Disabilities Act claim, but denied its motion on the Title VII claim. The judge concluded that the federal Religious Freedom Restoration Act did not provide a defense in this private-party suit and that Turbocam’s Free Exercise argument did not entitle it to summary judgment under current precedent.
Court status: The Title VII claim is the only claim remaining for trial. The court did not decide final liability; a jury may resolve the disputed discrimination claim.
