Supreme Court to Hear Colorado Catholic Preschool Funding Case November 3

October 4, 2026

The Supreme Court has scheduled oral argument for November 3 in St. Mary Catholic Parish v. Roy, a dispute over Colorado’s Universal Preschool Program. Two Catholic parishes challenge the state’s equal-opportunity condition, which requires participating providers to serve eligible children without discrimination based on sexual orientation or gender identity. The parishes say the condition conflicts with their religious beliefs and burdens their free-exercise and speech rights. Colorado defends the rule as a neutral condition for providers participating in the publicly funded program.

Court status: The Tenth Circuit upheld the requirement, and the Supreme Court granted review. The Court has not yet ruled on the merits; argument is set for November 3.
