Judge Hears Request to Keep CNN, MS NOW and Politico’s White House Access Restored

What happened: Lawyers for CNN, MS NOW, and Politico asked a federal judge on October 8 to continue protecting their reporters’ access to the White House while the outlets’ lawsuit proceeds. The Justice Department defended the administration’s restrictions at a hearing before U.S. District Judge Timothy Kelly.

The outlets argue that President Donald Trump’s decision to bar their journalists was retaliation for critical coverage and violates their First Amendment rights. The administration has argued that the restrictions were justified by concerns about reporting practices and national security.

Court status: Judge Kelly had temporarily blocked the ban in September and reporters’ access was restored. At the October 8 hearing, he extended that temporary protection through Tuesday and said he expects to rule by then on the outlets’ request for a preliminary injunction. The court has not yet issued a final ruling on the merits of the case.

Why it matters: The dispute concerns the standards the White House may use when granting or revoking press access and whether the challenged decision was based on viewpoint or on permissible access criteria. Those are the parties’ arguments and questions before the court, not findings that the case has already resolved.
