Judge Weighs ABC’s Challenge to FCC License Review After Free-Speech Hearing

October 7, 2026 — Court Watch / Free Speech / Breaking News.

A federal judge heard arguments October 6 on ABC parent company Disney’s request to block the Federal Communications Commission’s early review of licenses for eight ABC-owned television stations. The licenses are not scheduled for routine renewal until 2028 through 2031.

Disney argues the early review is retaliatory and violates the First Amendment, saying government pressure tied to ABC programming is affecting editorial decisions. The FCC disputes that account and says its review followed a dispute over Disney’s response to document requests concerning its diversity practices. The administration also argued that the federal district court is not the proper venue and that Disney had not shown irreparable harm.

Status: U.S. District Judge Loren AliKhan did not rule at the hearing and requested additional written arguments. The court’s decision on Disney’s request for preliminary relief remains pending. The competing explanations are the parties’ litigation positions, not findings by the court.
