Federal Agencies Find U.C. Berkeley Law Used Race in Admissions

DOJ and the Department of Education found that Berkeley Law discriminated against White and Asian applicants. Berkeley disputes the finding. No court has adjudicated the matter.

St. Louis Sheriff’s Office Resolves 13 EEOC Race and Age Charges

Status: Conciliation; no admission. Reported: September 2026.

The EEOC found reasonable cause concerning terminations of White and Black employees. The office denied the allegations and resolved the charges through pre-litigation conciliation.

EEOC Sues The New York Times Over Alleged Race- and Sex-Based Promotion Decision

Status: Pending federal lawsuit. Reported: May 2026.

The EEOC alleges that a qualified White male editor was excluded from final interviews because of race and sex. The allegations remain unproven.

Federal Scrutiny of Race-Conscious Workplace Programs: NIKE and Planned Parenthood

Status: Active investigation and resolved conciliation. Reported: 2026.

EEOC Seeks Enforcement of San Francisco DEI-Training Subpoena

The EEOC seeks records concerning a former employee’s allegations of race and sex discrimination involving mandatory DEI training. The allegations have not been adjudicated.

Supreme Court and Constitutional Law

Supreme Court Rejects Louisiana’s Race-Based Congressional Map

Status: Final Supreme Court decision. Decided: April 29, 2026.

In Louisiana v. Callais, the Court held that the Voting Rights Act did not require the additional majority-minority district, so the state lacked a compelling interest for the race-predominant map.

South Africa’s 2025 Employment Equity Targets: What the Rules Require

South Africa Constitutional Court Limits Rigid Use of National Racial Targets

Canada’s Employment Equity Act: Designated Groups, Goals, and Legal Limits

Status: Current federal statute; reviewed through July 21, 2026.

The Act requires employment-equity planning for covered employers while preserving essential qualifications and merit requirements and barring fixed, arbitrary quotas in enforcement orders.
